The driver named on your agreement must have a full valid UK driving licence and must be over 25 years of age and under 75 years of age.
The Vehicle must not be driven by any person who suffers from any loss or loss of use of limb, eye, defective hearing or vision (not corrected by spectacles or hearing aid), a heart/diabetic/epileptic condition or from any other infirmity that should be disclosed to DVLA.
The Vehicle must not be driven by any person who has during the past 5 years been convicted of any of the following offences: manslaughter, causing death by dangerous or reckless driving, offences that have resulted in suspension or disqualification from driving in the past 5 years. The Vehicle must not be driven by any person who has not held a full driving licence for at least 24 months.
The Vehicle must not be driven by any person who has during the last 3 years made 2 or more claims where the cost of each claim has not been recovered from any other party.
RENTAL PERIOD:
You will have use of the Vehicle until the return time and date specified on your Agreement. If you do not bring the vehicle back on time you are breaking the conditions of this Agreement and you will be charged £49 for each day or part day that you are late in bringing the Vehicle back. We may agree to extend the rental period but the rental period may never be more than 7 days.
YOUR RESPONSIBILITIES:
You can only rent the Vehicle as a domestic customer and not as a business customer for business purposes.
You must not let anyone other than yourself drive the Vehicle. You must look after the Vehicle and the keys to the Vehicle. You must always lock the Vehicle when you are not using it. You must always use the correct fuel. You must not let anyone work on the Vehicle without our permission. You must inspect the Vehicle prior to taking possession of it. You must stop using the Vehicle and contact us as soon as you become aware of a fault with the Vehicle. You are responsible for any damage to the Vehicle. You must not sell, rent or dispose of the Vehicle or any of its parts. You must not give anyone any legal rights over the Vehicle.
You must return the Vehicle during our opening hours. You must have the Vehicle inspected by a member of our staff when you return the Vehicle. You will be responsible for any damage to the vehicle whilst it is in your care. If the Vehicle is not returned in the same condition you will be charged for cleaning / valeting.
You must check you have not left any possessions in the Vehicle when it is returned. You must not smoke in the Vehicle.
USE OF THE VEHICLE:
The Vehicle must only be used by the driver named on your Agreement.
The Vehicle must not be driven outside England, Scotland and Wales.
The Vehicle must not be loaded beyond the manufacturer’s maximum weight recommendations. The Vehicle must not be driven off road. The Vehicle must not be driven in airport service roads and associated airside areas or in close proximity to any aircraft. The Vehicle must not be used; for hire or reward. The Vehicle must not be used to carry goods of an inflammable, corrosive, explosive or dangerous nature. The Vehicle must not be used for any illegal purpose.
The driver must not drive the Vehicle under the influence of drugs or alcohol.
OUR RESPONSIBILITIES:
We will have maintained the Vehicle to at least the manufacturers recommended standard and assure you that the Vehicle is roadworthy and suitable for renting at the start of the rental period. We will have arranged insurance with a reputable insurer subject to the terms and conditions of the insurance policy.
PROPERTY:
We will only be liable for damage or loss to property being carried in the Vehicle if the damage or loss results from our negligence or a breach of contract.
LIABILITY:
For the period of the rental you will be liable as the driver of the Vehicle for any fixed penalty offence committed with respect to the Vehicle or any penalty charge notice, any excess charge or penalty charge for parking or bus lane contraventions which may be incurred and any charges and penalty charges incurred under a road user charging scheme. You must pay the appropriate authority any fines and costs if and when the authority demands payment.
CHARGES:
You will pay the rental charge, if applicable, and any excess protection, if applicable. If you have used and not replaced the fuel in the Vehicle we will charge you for refuelling the Vehicle and in addition a service charge of £15.
You will pay the reasonable cost of repairing any damage to the Vehicle that was not noted on our vehicle check form at the start of the agreement, whether you were at fault or not. If you return the Vehicle and we consider it needs cleaning we will charge you a reasonable cleaning fee.
EXCESS PROTECTION:
If you do not accept excess protection then you will be liable for £800 of any loss caused by damage to or theft of the Vehicle. If excess protection has been accepted then your liability will reduce to £200. You agree that excess protection does not exempt you from liability for damage caused by use of incorrect fuel.
EXCESS MILEAGE:
Your hire cost includes 150 miles per day, anything after that is charged at 20p per mile and will be taken out of your deposit along with your hire charge.
WHAT TO DO IF YOU HAVE AN ACCIDENT:
If you have an accident you must not admit responsibility to anyone. You should get the names and addresses of everyone involved, including witnesses. If anyone is injured you must tell the police straight away. You must immediately inform a member of our staff. You agree to complete an accident report form and provide assistance to us and our insurers in any legal proceedings including allowing proceedings to be brought by us in your name and defending any proceedings brought against you.
BREAKDOWN PROCEDURE:
If you breakdown our AA details are on your Van Hire Envelope and you will need the membership card which is in the glovebox of the vehicle. If the vehicle cannot be fixed at the roadside and has to be towed it MUST be towed back to the garage that is listed on the breakdown procedures If the breakdown is outside of office hours then the vehicle should be left outside the garage and the keys posted through their letterbox. Under no circumstances should you use our breakdown cover to take you to your destination.
CANCELLATION:
If you book a van and then wish to cancel the booking you will be charged a £49 CANCELLATION FEE.
